EU Proposes Game-Changing Copyright Rules for Generative AI

An early EU agreement that may pave the way for the first comprehensive legislation controlling the technology requires companies using generative AI tools, such as ChatGPT, to report any copyrighted content used to construct their systems.

With the debut of OpenAI’s AI-powered chatbot ChatGPT, the developing technology experienced a boom in investment. And popularity, prompting the European Commission to start crafting the AI Act nearly two years ago.

Members of the European Parliament decided to advance the draught to the trilogue. Where EU legislators and member states will work out the bill’s final features.

According to the proposals, AI tools will be ranked from minimal to limited, high, and unacceptable in terms of perceived risk. An issue might include biometric surveillance, disseminating false information, or using language that is biassed.

High-risk instruments won’t be outlawed, but those who use them will need to be very open about their business practises. Companies using tools for generative AI, like ChatGPT or the Midjourney picture generator, will also need to disclose any copyrighted materials they utilised to create their systems.

According to a person with knowledge of the discussions, this clause was tacked on at the last minute. And were developed during the last two weeks. Committee members considered banning copyrighted content for generative AI training. But decided on transparency measures instead.

Svenja Hahn praised the European Parliament for reaching a balanced compromise on regulating AI that would protect citizens’ rights while promoting innovation.

When it introduced ChatGPT towards the end of last year, Microsoft-backed OpenAI sparked wonder and dread throughout the entire planet. The chatbot quickly surpassed 100 million monthly active users and became the fastest-growing consumer application in history.

Some observers were concerned about the subsequent race among tech companies to release generative AI products. Twitter owner Elon Musk supported a plan to halt the creation of such systems for six months.

The Financial Times said that shortly after signing the letter, Musk intended to found his own business to compete with OpenAI.
